Clare Milne secures 1.2 million for negligently performed laparoscopic anterior resection surgery

Our client (SM) underwent a negligently performed laparoscopic anterior resection on the 15th of January 2019. During the course of this procedure, her vagina was negligently stapled to the upstream bowel. The transvaginal stapling resulted in an anastomosis between the colon and the vagina. SM was forced to undergo several further surgeries and developed a pulmonary embolism.

SM was left with a permanent ileostomy with high output. She suffers chronic fatigue and infections and has developed a hernia as a consequence of the negligence. Furthermore, she suffers permanent sexual dysfunction due to a shortened vagina. In addition to the physical injuries, SM sustained significant psychological injuries in the form of a mixed anxiety and depressive disorder.

Following an admission from the Defendant, a lengthy period of negotiation and a Round Table Meeting, we secured a settlement of £1.2 million for our client.

Speaking after the claim had concluded, SM said:

“Clare Milne and her team held my hand, provided continual strength and guidance and managed the difficult process of claiming for a life changing event I never expected to happen. Taking legal steps wasn’t an easy decision and it was such a relief to have someone with Clare’s professional knowledge and experience lead the claim on my behalf. I would thoroughly recommend Clare and Girlings to anyone looking to engage a solicitor in this sector.”
